Under Utah Code §58-37-8, it is illegal to knowingly or intentionally produce, manufacture, dispense, or possess with intent to produce manufacture or dispense, a controlled or counterfeit substance. It is also illegal to distribute a controlled or counterfeit substance with the intent to distribute.
Cultivating marijuana is classified as a third-degree felony. If it is an alleged offender’s second or subsequent conviction, it will be classified as a second-degree felony. A third degree felony is punishable by incarceration of up to five years in prison and/or a fine of up to $9,500 in fines.
A conviction of any marijuana crime will result in your license being suspended for six months.
